JAMIO OPENWORK SERVICES USE POLICY

1. General information


This document (hereinafter referred to as the Usage Policy ) details the usage policies for the application services developed by Openwork srl, headquartered in Bari, Italy, at Via M. Partipilo 38, VAT number 05252520720 (hereinafter referred to as Openwork ), accessible at http://paas.jamio.com (hereinafter referred to as the Services ). Use of the Services is subject to acceptance of the Usage Policy . If you do not accept them, please do not use the Services.

2. Definitions


For all definitions, please refer to art. 2 of the Conditions .

3. Inappropriate use


The User is prohibited from using the Services inappropriately. For example, the User must not perform or attempt to perform the following activities:

Store, send, post, or transmit any information that:
– infringes or violates any third party IP rights, trade secrets, trademarks, patents, or other proprietary rights;
– contains offensive content;
– contains viruses, worms, Trojan horses, or other contaminating or destructive features;
– damages, violates, or attempts to violate the secrecy of correspondence and the right to privacy;
– is false, misleading, or deceptive;
send unsolicited communications, promotions, or advertisements, or spam;
send altered, deceptive, or falsely identify information, including “spoofing” or “phishing”;
promote or advertise products or services other than those you own without the relevant authorization;
collect or use email addresses, names, or other identifiers without the consent of the person concerned (including, without limitation, spamming, phishing, internet scams, password theft, spidering);
collect or use information about others without the consent of the owner of the information;
access or use any data, system, or network without authorization, including any attempt to probe, scan, or test the vulnerability thereof;
access, tamper with, or use non-public areas or portions of the Services, or shared areas of the Services that you have not authorized;
engage in any activity that interferes with the use of the Services by any User thereof;
interfere with or tamper with any user, host, or network, such as by sending viruses or spamming, overloading, or using flooding or mail-bombing techniques in any part of the Services;
access or search the Services through means other than publicly supported interfaces (e.g., by “scraping”);
use automated systems or other means to create a large number of Accounts or to access the Services through means other than the official interface and/or APIs;
abuse Openwork and its Resellers' recommendations or promotions to obtain more Services than those purchased;
abuse the Services in a way that circumvents the limits imposed on them by the terms of purchase;
offer information to the public (whether textual or graphic) that is harmful to the image of Openwork and its Resellers;
decode the Services or perform reverse engineering operations on the Services, as well as attempt or assist anyone to do so, unless such restriction is prohibited by law;
that in any case violates applicable legislative and/or regulatory provisions.

4. Use of system resources


Users may not develop or run Jamioware that interferes with the normal operation of the Services. In such circumstances, Openwork may request that the Services be restored to normal operation if, at its sole discretion, such non-compliant use conflicts with the use of other Users.
The Customer and Users are required not to use equipment that is defective or not certified to European standards, or that exhibits malfunctions that may damage the integrity of the network and/or disrupt the Services and/or create risks to the physical safety of individuals. Openwork does not provide any guarantee regarding the compatibility of the equipment used by the Customer with the Services, as all related verifications are the sole responsibility of the Customer.

5. Vulnerability testing


The User may not in any way attempt to probe, examine, penetrate, or test the vulnerability of the Services or violate the security of the Services or their authentication procedures, whether through passive or invasive techniques, without the express written consent of Openwork, nor, similarly, may he/she carry out such activities through the Services against third-party systems and/or information without their explicit consent.

6. Offensive Content


You may not store, post, publish, or transmit through the Services any content that Openwork reasonably believes:

Constitute, depict, encourage, promote, or refer in any way to pedophilia, racism, bigotry, terrorism, or pornographic content that is not posted in compliance with applicable laws and accessible only to persons of legal age;
be excessively violent, incite violence, contain threats, harassment, or hate speech;
be unfair or misleading under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes;
be defamatory or violate the privacy of any person;
create a risk to personal safety or health, a risk to public safety or public health, compromise national security, or interfere with law enforcement investigations;
improperly disclose trade secrets or other confidential or proprietary information of others;
be intended to assist others in circumventing copyright rights;
violate another's copyright, trademark, patent, or other proprietary right;
promote illegal drugs, violate export control laws
, relate to illegal gambling, or illegal arms trafficking;
be otherwise illegal or solicit illegal conduct under applicable laws in the relevant jurisdiction, the Customer, or Openwork;
be otherwise harmful, fraudulent, or could result in legal action against Openwork or the Reseller, if designated;
contain defamatory, libelous, or threatening content;

By content “posted or transmitted” through the Services we mean any type of file, structured or unstructured data.

7. Copyrighted material


You may not use the Services to download, post, distribute, copy, or otherwise exploit in any way any copyrighted text, music, software, art, images, or other works, except where:

has been expressly authorized by the copyright owner;
is otherwise permitted by applicable copyright laws in the relevant jurisdiction.
