JAMIO OPENWORK SERVICES USAGE POLICY

1. Generalities


This document (hereinafter referred to as Policy of Use) details the policies for the use of the application services, developed by Openwork srl with registered office in Bari-Italy at via M. Partipilo 38, P.IVA 05252520720 (hereinafter referred to as Openwork), accessible at http://paas.jamio.com (hereinafter referred to as Services). Use of the Services is subject to acceptance of the Policies of Use. If you do not agree, you are requested not to use the Services.

2. Definitions


Where mentioned, the terms below shall, for the purposes of the Contract, have the meanings set out in the Jamio openwork Glossary.

3. Inappropriate use


The User is prohibited from using the Services in an inappropriate manner. For example, the User must not carry out or attempt to carry out the following activities: 

Store, send, publish, transmit information that:
- conflict with or violate IP Rights, trade secrets, trademarks, patents or other proprietary rights of third parties;
- contain offensive content;
- Contain viruses, worms, Trojan horses, or otherwise contaminating or destructive features;
- damages, violates or attempts to violate the secrecy of correspondence and the right to privacy;
- is false, misleading or deceptive;
send unsolicited communications, promotions or advertisements or spam;
send information that is altered, misleading or with false identification of origin, including "spoofing" or "phishing";
promote or advertise products or services other than those you own without the relevant permissions;
collect or use e-mail addresses, names or other identifiers without the consent of the person concerned (including, without limitation, spamming, phishing, internet scams, password theft, spidering)
collecting or using third party information without the consent of the owner of the information;
unauthorized access to or use of data, systems or networks, including any attempt to probe, examine or test their vulnerability;
access, tamper with or use non-public areas or portions of the Services or shared areas of the Services to which it has not been authorized;
engage in activities that interfere with the use of the Services by any User of the Services;
interfere with or tamper with any user, host, or network, such as by sending viruses or spam, overloading, or using flooding and mail-bombing techniques in any part of the Services;
access or search the Services through means other than publicly supported interfaces (e.g., by "scraping");
use automated systems or other means to create large numbers of Accounts or to access the Services by means other than the official interface and/or APIs;
abuse Openwork's and its Resellers' recommendations or promotions in order to obtain more Services than those purchased;
abuse the Services in a way that circumvents the limits imposed on them by the conditions of purchase;
offer information to the public (textual or graphic) that is harmful to the image of Openwork and its Resellers;
reverse engineer the Services or perform reverse engineering of the Services, as well as attempt or assist anyone to do so, unless such restriction is prohibited by law;
which in any case are contrary to applicable statutory and/or regulatory provisions.

4. Use of system resources


Users may not develop and execute Jamioware that interferes with the normal functioning of the Services. In such circumstances, Openwork may request to restore the level of normality if such non-compliant use conflicts, in its sole discretion, with the use of other Users. The Customer and the Users are obliged not to use faulty equipment or equipment which is not approved according to European standards, or which presents malfunctions which could damage the integrity of the network and/or disturb the Services and/or create risks to the physical safety of persons. Openwork, in fact, does not provide any guarantee as to the compatibility of the equipment used by the Customer with the Services, all the relevant checks being the sole responsibility of the Customer.

5. Vulnerability testing


The User may not in any way attempt to probe, examine, penetrate or test the vulnerability of the Services or to breach the security of the Services or its authentication procedures, whether by passive or invasive techniques, without the express written consent of Openwork, nor may he or she carry out such activities via the Services against third party systems and/or information without their express consent.

6. Offensive Content


It is forbidden to store, send, publish, transmit, via the Services, content that Openwork reasonably believes:

constitute, depict, encourage, promote, or refer in any way to pedophilia, racism, bigotry, terrorism, or pornography content that is not included in compliance with relevant regulations and accessible only to persons of legal age;
be excessively violent, incite violence, contain threats, harassment, or hate speech
be unfair or deceptive in relation to the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes;
be defamatory or violate a person's privacy;
create a risk to personal or health safety, a risk to public safety or public health, compromise national security, or interfere with investigations by the Judicial Authority;
improperly disclose trade secrets or other confidential or proprietary information of others;
have the purpose of helping others circumvent copyright rights;
violate the copyrights of others, trademarks, patents or other property right of others;
promote illegal drugs, violate
export control laws, relate to illegal gambling or illegal arms trafficking;
be otherwise illegal or solicit illegal conduct under applicable laws in the relevant jurisdiction, of the Customer or Openwork;
be otherwise harmful, fraudulent or likely to lead to legal action against Openwork or the Reseller, if designated.
Have defamatory, libelous or threatening content;

Content "posted or transmitted" via the Services means any type of file, structured and unstructured data.

7. Copyrighted material


The use of the Services to download, publish, distribute, copy or use in any way any text, music, software, art, image or other work protected by copyright is prohibited except where: 

has been expressly authorized by the right holder;  is otherwise permitted under applicable copyright laws in the relevant jurisdiction.
