GLOSSARY OF TERMS JAMIO OPENWORK

 

1. Definitions


The following are the main terms and definitions applicable in Openwork's business domain called out in the various sections of the General Terms and Conditions of Supply:

  • IaaS: stands for Infrastructure As A Service, IT infrastructure delivered as a service.
  • Virtual Infrastructure: the IaaS used by Openwork to deliver the Services.
  • PaaS: stands for Platform As A Service, software platform delivered as a service.
  • Jamioware: software application developed with Jamio openwork technology.
  • Services: the PaaS Jamio openwork, the Jamioware delivered on the PaaS Jamio Openwork, and any specific features.
  • Specific supply conditions: documents defining the specific supply conditions of specific Jamioware or specific features as listed in items 7, 8, 9, 10, 11, 12 and 13 of Article 1.
  • HelpDesk Credit: the right to perform a transaction; when the transaction is performed or the benefit disbursed the Credit is cancelled.
  • SLA: stands for Service Level Agreement, a set of metrics that define the quality of a service.
  • Customer: the legal entity that concludes the contract for the provision of the Services by Openwork.
  • Referrer: the individual person, designated by the Customer, to whom communications are sent by Openwork regarding the provision and use of the Services and who may configure the use of the Services.
  • User: the individual person or system using the Services, identified by the Access Credentials.
  • End User: the individual personUser.
  • Login credentials: user name and password to access a software system.
  • Account: login credentials, features, tools and content assigned to a User.
  • Area: set of features and data delivered and managed by the Paas Jamio openwork whose access is restricted to theUser.
  • Area Identifier: a unique name identifying the Area, used in conjunction with the Access Credentials to access the Services.
  • User: the organization that uses the Services, defined as a set of Users authorized by the Customer to access and use the Services.
  • Area Identifier: a unique name that identifies theUser and used to identify the Area of access to the PaaS Jamio openwork.
  • Area Administrator: an account with privileges to administer the Services in a specific Area.
  • Customer Data: the contact details of the Customer and Contact Person provided by the  to Openwork.
  • Managed Data: the files and structured data that Users send to or receive from the Services.
  • Archived Data: the Managed Data that is given persistence within the Services.
  • Data: means Managed Data, Customer Data, Archived Data.
  • Reseller: means a legal entity authorized by Openwork to resell the Services.
  • Activation Request: the document that validly signed by the Customer, containing the specifications, the mode of administration of the Services, the Reseller and all required data, formalizes the request for activation of the Services.
  • Additional Activation Request: an Activation Request referring to a User, as identified by theUser Identifier shown in the Request, for whom the Customer has already issued an initial Activation Request and which formalizes the request for activation of additional Services pursuant to Article 17.
  • Activation Request Date: the date in the Activation Request or Additional Activation Request beyond which the Customer requests that the Services be activated.
  • Deactivation Request: the document that validly signed by the Customer, containing the UserIdentifier, the list of Services to be deactivated, and sent to Openwork formalizes the request to deactivate Services for a User in accordance with Article 1.
  • Designated Reseller: the legal entity identified as the Reseller in the Activation Request, if not indicated means Openwork.
  • Credit: An amount awarded by Openwork to the Customer or Reseller that the Customer or Reseller may use as a deduction to amounts due for Activation Requests or Activation Requests.
  • Security-related emergencies: means (a) a use of the Services that causes or may cause an interruption of the Services or damage to the infrastructure used to provide the Services, and (b) unauthorized third-party access to the Services.
  • API: stands for Application Programming Interface, a set of software procedures and instructions used programmatically to use Services.
  • 24/7/365: an acronym for the provision of a service done seamlessly 24 hours a day, seven days a week, 365 days a year.
  • OEM mode: use of the Services within services or software applications of the Customer intended for sale and on which the Customer affixes its brand name.
  • Third Party Requests: means requests from qualified third parties for Data. Third Party Requests may include search warrants, court orders, subpoenas, or any other request for which there is no written consent from the Customer allowing disclosure.
  • IP Rights: any and all rights, current and future, at the Italian, Community or international level, arising from a patent, trademark, utility model, design, copyright, software, trade secrets, images or other identifying marks, moral rights and other related rights or any other industrial and/or intellectual property right, including also the right to one's name, personal image and confidentiality of one's Personal Data.
  • Personal data means any information relating to an identified or identifiable natural person; an identifiable person is one who can be identified, directly or indirectly, by reference in particular to an identifier such as a name, an identification number, location data, an online identifier, or to one or more features of his or her physical, physiological, genetic, mental, economic, cultural or social identity.
  • GDPR: Regulation (EU) 2016/679 of the European Parliament and Of the Council of April 27, 2016 on data protection.
  • GDPR Conditions: the document prepared by Openwork, published at http://www.jamio.com/condizioni-gdpr, in which the Parties' obligations regarding the use of the Services in accordance with the GDPR are described.
  • Jamio Plug: Components available in the Paas Jamio openwork that expose ancillary functionality related to specific uses or application domains;
  • Jamio Beats: A logical unit used to quantify the usage of the features exhibited by Jamio Plugs. Each feature can correspond to a different number of beats depending on its technical and functional characteristics.
  • Processing: any operation or set of operations, carried out even without the aid of electronic instruments, concerning the collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, dissemination, erasure and destruction of data even if not registered in a database. Even one of the listed operations on a Personal Data is sufficient to deem a Processing of Personal Data to be taking place.
  • Data Controller. The entity (the individual person or legal entity, public authority, service or other body) that, individually or jointly with others(Data Controller), determines the purposes and means of the Processing of Personal Data.
  • Data Processor. The entity (the individual person or legal entity, public authority, service or other body) outside the structure of the Data Controller that processes Personal Data on behalf of the latter
  • Safeguard Period: Period between the deactivation of the Services and the deletion of the Data.
  • Openwork Privacy Policy: the document drafted by Openwork, published at http://www.jamio.com/policy-privacy-openwork, which describes the way in which Customers ' Personal Data is processed and contains the information in accordance with Article 13 of the DGPR and current legislation.
  • OpenworkIntellectual Property Policy: the document drafted by Openwork, published at http://www.openworkbpm.com/policy-proprieta-intellettuale-openwork, in which are contained the obligations of Customers regarding the protection of IP Rights owned by Openwork, as well as the faculties actionable, in this regard, by Openwork itself.
  • Jamio openwork services use policy: the document prepared by Openwork, published at http://www.jamio.com/policy-utilizzo-servizi-jamio, in which users' obligations regarding the use of the Services are described.
  • Protection Policy: the document prepared by Openwork, published at http://www.jamio.com/policy-protezione/, in which the automatic mechanisms for protection from misuse adopted in the Services are described;
  • Retention Policy: the document prepared by Openwork, published at http://www.jamio.com/policy-retention/, in which the time limits for retention of certain information managed by Services Services that does not have application value are described;
  • Price List: the web page, at http://www.jamio.com/listino-servizi-jamio, listing the prices of Services.
  • PEC: certified electronic mail, a special type of electronic mail, regulated by Italian law, which allows an electronic mail message to be given the same legal value as a traditional registered letter with return receipt.
  • Openwork Help Desk Service: a service provided by Openwork through the Openwork PaaS Jamio, as detailed in the Openwork Help Desk Service Specific Terms of Delivery document.
  • Specific condition for the provision of Openwork Help Desk Service: a document specifying the terms of delivery of the Openwork Help Desk Service, published at https://www.jamio.com/en/help-desk-supply-conditions/.
  • Specific condition of provision of Jamio openwork Dedicated Web Access Service: a document specifying the terms of delivery of the service provided by Openwork through the Jamio Openwork PaaS called Dedicated Web Access, published at https://www.jamio.com/en/dedicated-web-access-supply-conditions/.
  • Specific condition of provision of Jamio Openwork Business Console Service: a document specifying the terms of delivery of the service provided by Openwork through the Jamio Openwork PaaS called Business Console, published at https://www.jamio.com/en/business-console-supply-conditions/.
